This is an excellent question. For most applications, you should search FAA Sectional Charts for your proposed location. If your propsed flight is located in Class B, C, D, and/or E2, you will need LAANC authorization for the flight and will have to submit a request for a specific date and time, which will only be available to a FAA Licensed Part 107 Remote Pilot Certificate holder.
Absolutely. Even if the pilot is licensed, registered, and is flying safe, if they do not have FAA LAANC (Low-Altitude Authorization and Notification Center) clearance, it is the same consequence as if an unlicensed person were flying a real airplane around Area 51... for both the pilot and the person that hired them.
This has been the subject of many of my rants. I have been personally stopped on the Las Vegas Strip, standing on public property, flying my drone with full FAA LAANC authorization and have nearly been arrested. I actually had to stop flying or the Las Vegas Police were going to arrest me. They had no idea what they were talking about and after speaking to a high-level supervisor, I am now whitelisted throughout Las Vegas.
